Assisted Reproductive Technology

Info

Considering (ART)?

Assisted Reproductive Technology (ART) is emerging as one of the fastest growing methods of creating a family.  Assisted Reproductive Technologies are treatments which include the handling of eggs, sperm and/or embryos.  These procedures are complex and the laws governing them are complicated.  We proudly represents Florida surrogates, egg donors, sperm donors, and embryo donors during the contract review stage through finalization of the third-party reproduction process.

Laws governing third party reproductive technology law are constantly changing; therefore, it is prudent to consult with a lawyer before entering into any type of egg, sperm, or embryo donation agreement. We will draft the necessary contracts, representing carrier, donors, and recipients and finalize the third-party reproductive arrangements under all aspects of Florida’s reproductive law.

The donation agreements between the recipients and the donor specifically detail the parties’ obligations and rights with regard to the donation and cover issues that may arise in third party reproductive technology including, but not limited to, parental rights of the intended parents and relinquishment of parental rights by the donating party, confidentiality, required medical testing, future communication between the parties, expenses, liability for complications, and the rights of the child(ren).

We can assist you in the reproductive process by referring you to reputable egg, sperm, and embryo donation agencies.  During every match between an intended parent and a surrogate or egg, sperm, or embryo donor, it is critical, and sometimes legally required, to have separate attorneys represent the intended parents and  the surrogate or donor and their spouse/partners. Separate legal representation is important to ensure that each of the parties are properly represented.  This also avoids any conflicts that may arise. It is crucial to have an attorney to represent you that specializes in reproductive law.
